Terms of Use
Ginga
Last updated: 14 September 2026
These terms are the agreement between you and us for your use of Ginga. By downloading or using the app you accept them. If you do not accept them, do not use the app.
Who you are agreeing with
Ginga is published by Daniel Nicolas Bond, a sole trader registered in Australia.
ABN 14 743 167 927 Queensland 4059, Australia hello@gingafit.app
"We", "us" and "our" mean the above. "You" means you.
Your licence
The app is licensed under Apple's Standard End User License Agreement. These terms describe Ginga's services, fitness limitations and purchase arrangements and do not replace that software licence or reduce your mandatory consumer rights. Apple Media Services usage rules also apply.
The app, its name, its design and its content remain ours. Your training data is yours; nothing in these terms gives us any claim over it.
Subscriptions
Where offered, some features may require a paid subscription or a one-time purchase. Available products and prices are shown in the app before purchase. Access offered free during development is not a promise of permanent free access.
- Payment through Apple. Purchases are processed through your Apple Account. Prices are shown in the app in your local currency before you buy, and include any tax Apple collects.
- It renews automatically. Payment is charged to your Apple Account when you confirm the purchase. The subscription renews at the end of each period unless it is cancelled at least 24 hours before that period ends. Renewal is charged within the 24 hours before the period ends.
- You cancel it through Apple. Manage or cancel your subscription in your Apple Account settings, on the device. We cannot cancel it for you, and deleting the app does not cancel it.
- Free trials, where offered, convert to a paid subscription unless cancelled at least 24 hours before the trial ends. Any unused part of a trial is forfeited when you buy a subscription.
- Restoring. A subscription is tied to your Apple Account, so it works on your other devices. Use Restore Purchases in Settings if it does not appear.
- Refunds are handled by Apple under Apple's own policy, at reportaproblem.apple.com. We are not able to issue refunds for App Store purchases.
- One-time purchases do not automatically renew. Their scope is described on the purchase screen.
- Price and content changes. Any changes are subject to applicable law and Apple's notification and consent requirements. We do not remove rights you already have under consumer law.
Health and fitness: read this part
Ginga is a fitness tracker, not a medical device, and nothing in it is medical advice. It does not diagnose, treat, cure or prevent any condition.
- Talk to a doctor before starting or changing how you exercise, particularly if you have a heart condition, an injury, are pregnant, or have any reason to think exercise may not be safe for you.
- Stop if you feel unwell, faint, short of breath or in pain, and get medical help.
- You exercise at your own risk. You are responsible for choosing what you do and for doing it safely.
- Do not rely on the numbers. Distance, pace, heart rate, calories, steps and elevation are estimates. They depend on GPS reception, the sensors in your devices, gym equipment reporting honestly, and settings you control. They can be wrong, sometimes badly. Do not use them for anything where being wrong matters.
- Do not use the app in a way that distracts you from traffic or your surroundings.
Your data
Your training history is stored on your device. What that means in detail is set out in our Privacy Policy, which forms part of these terms.
You are responsible for keeping your own copy of anything you would be upset to lose. Settings → Export Data makes one. We hold no backup of your data and cannot recover it for you. Copies may remain in Apple Health, your device backups, paired devices or destinations you chose when exporting or sharing.
Australian Consumer Law
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Where it applies, you retain the remedies provided by that law, including remedies for major and other failures and compensation where applicable. Other mandatory consumer protections may apply where you live.
Nothing in these terms excludes, restricts or modifies those rights.
Everything else about liability
Subject to the section above, and to the fullest extent the law allows:
- Ginga is provided as it is. We do not promise it will be uninterrupted, free of errors, or accurate.
- We are not liable for indirect or consequential loss, or for loss of data, profit or opportunity.
- Where we are liable and the law allows us to limit that liability, it is limited to resupplying the app or subscription, or paying the cost of doing so.
Ending this agreement
You may stop using Ginga at any time by deleting it, and cancel any subscription through Apple. We may end this licence if you break these terms. The sections on health, data, liability and governing law survive it ending.
Apple
You acknowledge that these terms are between you and us and not with Apple, that Apple is not responsible for the app or its content, and that Apple has no obligation to provide support for it. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
Changes
We may update these terms. The date at the top changes when we do, and material changes will be noted in the app's release notes. Continuing to use the app after a change means you accept it.
Governing law
These terms are governed by the laws of Queensland, Australia. You and we submit to the non-exclusive jurisdiction of the courts of that state. If you live elsewhere, this does not take away any right you have to bring a claim under your own local consumer law.
